Terms of Use

These Terms of Use ("Terms") govern all services provided by DIVO3D LLC ("DIVO3D," "we," "us"), a Washington limited liability company located in Marysville, Washington, including 3D printing, CAD design, 3D scanning, and related services. By requesting a quote, placing an order, or using our website (divo3d.com), you ("Client," "you") agree to these Terms. Our Privacy Policy and Refund & Reprint Policy are part of these Terms.
1. Our Services
DIVO3D provides custom 3D printing (FDM and resin), CAD design and modeling, 3D scanning and reverse engineering, rapid prototyping, and related services. All work is custom and made to order unless otherwise stated. We may accept or decline any project at our discretion.
2. Quotes, Pricing, and Payment
Quotes are estimates based on the information and files you provide and are valid for 30 days unless stated otherwise. If the scope, files, materials, or requirements change after quoting, the price may change, and we will tell you before proceeding. These Terms are incorporated by reference into every quote and invoice; your acceptance of a quote, submission of an order, or payment of an invoice constitutes acceptance of these Terms. Any conflicting or additional terms in a Client purchase order or other document are rejected and do not apply unless DIVO3D expressly accepts them in writing. Payment terms (full payment or deposit before production) are stated in your quote or invoice. Payments are processed through Square. Work does not begin until required payment is received. Completed orders held for pickup or awaiting client response for more than 30 days after written notice may be subject to storage fees or disposal.
3. Client Files and Responsibilities
You are responsible for the accuracy of the files, measurements, specifications, and instructions you provide. We print and build to what you give us and approve. You represent and warrant that you own or have the legal right to use all files, designs, and content you submit, and that our performance of the services will not infringe any third party's intellectual property or other rights. We may decline any file or project we believe infringes third-party rights or violates law.
4. Prohibited Items
We do not produce: firearm frames, receivers, or components regulated under federal law or Washington law (including RCW 9.41.325 and 9.41.326); items that are illegal to manufacture or possess; items that infringe third-party intellectual property without authorization; or items intended to deceive, harm, or endanger others. Non-regulated firearm accessories may be considered at our sole discretion. We may refuse any project at any time if we believe it falls into these categories.
5. Design Approval and Revisions
For design and modeling work, the number of included revisions is stated in your quote; additional revisions are billed at our current rate. Before production, you will be asked to approve the final design, model, or proof. Your written approval (including email or message approval) confirms the design is correct and complete. Parts produced in conformity with your approved design are accepted as to design, dimensions, and features. Changes requested after approval are billed as new work.
6. Production Standards and Tolerances
3D printing is an additive manufacturing process with inherent characteristics, including visible layer lines, minor surface texture, small cosmetic marks (such as support contact points), slight color variation between materials and batches, and dimensional variation typical of FDM and resin processes. These characteristics are normal and are not defects. If your project requires specific tolerances, surface finishes, or engineering properties, these must be agreed in writing before production. We will select print settings and orientation using our professional judgment unless otherwise agreed.
7. Suitability and Intended Use
Unless expressly agreed in writing, our parts and deliverables are not tested, rated, or certified for safety-critical, load-bearing, medical, food-contact, aerospace, automotive, or life-safety applications. You are solely responsible for evaluating and validating the suitability, safety, and legal compliance of any part or design for your intended use. 3D printed parts can have different strength and durability characteristics than machined or injection-molded parts. Small printed items can present choking hazards and are not toys for young children unless expressly designed and agreed as such.
8. Scanning Services
3D scanning accuracy depends on the object's size, geometry, surface, and material. Scan data and reverse-engineered models are produced to commercially reasonable accuracy for the agreed purpose. If you require specific scan accuracy, it must be agreed in writing before work begins.
9. Timelines, Shipping, Delivery, and Risk of Loss
Completion and delivery dates are good-faith estimates, not guarantees, and time is not of the essence unless expressly agreed in writing. We will keep you informed of material delays. We ship via third-party carriers or arrange local delivery/pickup as agreed. Risk of loss or damage passes to you upon our delivery of the order to the carrier, or upon handoff for pickup/local delivery. If an order arrives damaged, follow the process in our Refund & Reprint Policy and we will assist with the carrier claim and make it right per that policy.
10. Inspection and Defect Claims
Inspect your order promptly. Claims for defects, errors, or damage must be reported within 14 days of delivery or pickup, with photos, to divo3dstudio@gmail.com. Remedies are described in our Refund & Reprint Policy. Orders not reported within 14 days are deemed accepted.
11. Cancellations
Cancellation terms, including what is refundable at each stage, are described in our Refund & Reprint Policy.
12. Confidentiality and Intellectual Property
Mutual Confidentiality. Each party agrees to keep confidential all non-public information received from the other party in connection with a project, including but not limited to design files, 3D models, scan data, drawings, specifications, prototypes, business plans, pricing, and technical information ("Confidential Information"). Neither party will use the other's Confidential Information for any purpose other than performing or receiving the services, and neither party will disclose it to any third party without prior written consent.
Permitted Disclosures. Confidential Information may be disclosed to employees or contractors who need it to perform the services, provided they are bound by confidentiality obligations at least as protective as this section. Confidential Information may also be disclosed if required by law, subpoena, or court order, provided the disclosing party gives the other party reasonable prior notice where legally permitted.
Exclusions. Confidential Information does not include information that: (a) is or becomes publicly available through no fault of the receiving party; (b) was lawfully known to the receiving party before disclosure; (c) is independently developed by the receiving party without use of the Confidential Information; or (d) is lawfully received from a third party without restriction.
Client Ownership. The Client retains all ownership rights in files, models, designs, and materials the Client provides. Upon full payment, the Client owns all custom designs, models, and deliverables created by DIVO3D specifically for the Client's project. DIVO3D retains ownership of its general knowledge, techniques, tools, and any pre-existing materials used to perform the services.
No Reuse. DIVO3D will not reproduce, sell, distribute, or manufacture the Client's designs or deliverables for any party other than the Client without the Client's written permission.
Publicity. DIVO3D will not publicly display, photograph, or describe the Client's project in marketing materials, portfolios, or social media without the Client's prior permission.
Return or Deletion. Upon written request after project completion, DIVO3D will delete the Client's files and Confidential Information, except for records DIVO3D is legally required to retain (such as invoices and signed agreements), which remain subject to this section.
Duration. These confidentiality obligations begin at first contact regarding a project and survive for three (3) years after the project ends, or for as long as the information remains a trade secret under applicable law, whichever is longer.
13. Warranties Disclaimer
EXCEPT FOR THE EXPRESS COMMITMENTS IN THESE TERMS AND OUR REFUND & REPRINT POLICY, OUR SERVICES AND DELIVERABLES ARE PROVIDED "AS IS," AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) DIVO3D'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO AN ORDER OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER; AND (B) DIVO3D WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOST PROFITS, LOST BUSINESS, OR REPLACEMENT COSTS, EVEN IF ADVISED OF THE POSSIBILITY. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to defend and hold DIVO3D harmless from third-party claims, damages, and reasonable costs (including attorney fees) arising from: (a) files, designs, or content you provided; (b) your use of parts or deliverables outside the agreed or intended purpose; or (c) your violation of these Terms or applicable law.
16. Refusal and Termination
We may pause or terminate work on a project if payment is not made, if these Terms are violated, or if we reasonably believe the project is unlawful or infringing. You will be charged for work completed up to that point, per the Refund & Reprint Policy.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Before filing any claim, both parties agree to attempt in good faith to resolve the dispute informally by contacting the other party. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Snohomish County, Washington, and both parties consent to that venue. Either party may instead use small claims court where eligible.
18. General Provisions
Force Majeure. DIVO3D is not liable for delay or failure to perform caused by events beyond its reasonable control, including equipment failure, material or supply shortages, power or internet outages, carrier delays, personnel illness or medical emergency, natural disasters, or government action. Timelines are extended for the duration of the event, and we will notify you of significant delays. If such an event prevents completion for more than 30 days, either party may cancel the affected order, and the Client will receive a refund for work not performed per the Refund & Reprint Policy.
Severability. If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions stay in full effect.
Entire Agreement; Order of Precedence. These Terms, together with the applicable quote or invoice, the Privacy Policy, and the Refund & Reprint Policy, constitute the entire agreement for each order. If a signed agreement or quote expressly modifies these Terms for a specific project, that document controls for that project.
No Waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. The Client may not assign an order without our written consent. DIVO3D may use qualified contractors bound by confidentiality obligations consistent with Section 12.
19. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on our website with its effective date. Orders are governed by the Terms in effect when the order is placed.
